Local Electoral Officials Must Face Worker’s Political Bias Suit

Lynchburg, Va.’s former general registrar can pursue individual-capacity claims against two electoral board members, including one who allegedly attended the Jan. 6 riot, over their successful votes denying her reappointment.

The ruling Thursday by the US District Court for the Western District of Virginia rejected by the board members’ contention that dismissal was warranted because the commonwealth is the real party in interest in the First Amendment political bias suit.

The civil rights suit was brought under 42 U.S.C. §1983, and the Fourth Circuit has held that a test it developed in a Fair Labor Standards Act case to …
